The Federally Mandated Marketplace (aka Exchange) Notice must be distributed to
ALL your employees no later than
October 1st, 2013. 

Whether you offer employees insurance or not you must send them this notice regardless of eligibility for coverage
and regardless of the number of hours they work. 

Be sure to notify employees through an acceptable delivery method and document when the notice was distributed,
to whom and by what method.

How to Amend Your Tax Return -IRS Tips

Have you ever wondered what to do if or when you discover an error after you file your individual tax return?

Here are some tips from the IRS you can use to correct any errors by amending your return.

 10 tips from the Internal Revenue Service about amending your federal tax return:

1. When to amend a return.  You should file an amended return if you need to correct your filing status, number of dependents, total income, tax deductions or tax credits. The instructions for Form 1040X, Amended U.S. Individual Income Tax Return, list additional reasons to amend a return.

2. When NOT to amend a return In some cases, you don’t need to amend your tax return. For example, the IRS usually corrects math errors when processing your original return. If you did not include a required form or schedule, the IRS will send you a request for whatever is missing.

3. Form to use.  Use Form 1040X to amend a previously filed Form 1040, 1040A, 1040EZ, 1040NR or 1040NR-EZ. Make sure you check the box to show the tax year that you are amending on the Form 1040X. You cannot e-file an amended return. You must file an amended tax return on paper.

4. Multiple amended returns.  If you’re filing an amended return for more than one year, prepare a separate 1040X for each return. Mail them in separate envelopes to the appropriate IRS processing center. (See "Where to File" in the instructions for Form 1040X.)

5. Form 1040X.  Form 1040X has three columns. Column A shows figures from the original return. Column B shows the changes you are making. Column C shows the corrected figures. There is also an area on the back of the form where you should explain the specific changes and the reasons for the changes.

6. Other forms or schedules.  If the changes involve other tax schedules or forms, attach them to the Form 1040X. Failure to do this will cause a delay in processing.

7. Amending to claim an additional refund.  If you’re expecting a refund from your original tax return, don’t file your amended return until after you have received that refund. You may cash the refund check from your original return. The IRS will send you any additional refund you are owed.

8. Amending to pay additional tax.  If you’re filing an amended tax return because you owe additional tax, you should file Form 1040X and pay the tax as soon as possible to limit any interest and penalty charges.

9. When to file.  To claim a refund, you generally must file Form 1040X within three years from the date you filed your original tax return or within two years from the date you paid the tax, whichever is later.

10. Processing time.  Normal processing time for amended returns is 8 to 12 weeks.

Delay of Pay or Play Employer Shared Responsibility for Health Insurance

 

Last week the treasury department announced the decision to delay employer reporting requirements regarding employees’ access to and enrollment in health insurance.  The reporting process for employers will be revamped and simplified and since employer responsibility payments are determined through employer reporting, no employer responsibility payments will be collected for 2014.

 This year the Portland District Office will honor Oregon's award winners at a lunch on May 20. Roughly 97.6% of the employers in Oregon are small business owners representing more than 335,000 small businesses. Their hard work and dedication deserves our recognition and gratitude, especially on this one day a year. Oregon Governor John Kitzhaber will be addressing the attendees and aiding in the presentation of the Small Business Person of the Year award. Additional small business awards include: Small Business Person of the Year, Small Business Exporter of the Year, 8(a) Graduate of the Year, Family-Owned Business of the Year, Director’s Impact Award, Director’s Rising Star Award, and Director’s Entrepreneurial Spirit Award. The event also recognizes leading SBA Lenders who provide the capital small businesses need to grow and succeed. Here in the Portland District, we’ve had back to back record years of lending following the Recession. In fiscal year 2012, these lenders delivered $428.7 million in supported loans, eclipsing the previous record year of $391.7 million in supported loans. FMLA Final Rule March 8, 2013

Several of the changes to the FMLA regulations made in this Final Rule, including military caregiver leave for a veteran,
qualifying exigency leave for parental care, and the special leave calculation method for flight crew employees, became
available on the effective date of the Final Rule on March 8, 2013. As the Department noted in the preamble to the Notice of Proposed Rulemaking, however, some of the provisions of the National Defense Authorization Act for Fiscal Year 2010
and the Airline Flight Crew Technical Corrections Act, such as the expansion of qualifying exigency leave to families
of members of the Regular Armed Forces and the special eligibility hours of service requirement for flight crew employees,
were effective as of the enactment date of those statutes. 77 FR 8962 (Feb. 15, 2012).

Oregon's Senate Bill 833

Following the passing of Oregon's Senate Bill 833, granting Driver's Licenses to undocumented workers, the federal government has issued reminders that federal law prohibits employment for people without proper legal presence. Employers must practice due diligence in verifying eligibility to work in the United States. In Oregon you must not assume if an immigrant presents a Drivers license for I-9 purposes that they are legally eligible to work in the US.

New I - 9 Released

New I-9 Form Released on 3/8/2013

U.S. Citizenship and Immigration Services (USCIS) has published a new Form I-9, Employment Eligibility Verification. The form is available for immediate use by employers. Employers who need to make necessary updates to their business processes to allow for use of the new Form I-9 may continue to use other previously accepted revisions (Rev.02/02/09)N and (Rev. 08/07/09)Y until May 7, 2013 date.

After May 7, 2013, all employers must use the revised Form I-9 for each new employee hired in the United States.

 The revised Form I-9 has several new features, including new fields and a new format to reduce errors. The instructions to the form also more clearly describe the information employees and employers must provide in each section.
